OPINION
LECHNER, District Judge.
On 24 December 1996, appellant Y.J. Sons & Co., Inc. (“Y.J.”) filed a voluntary petition (the “Petition”) for bankruptcy protection, pursuant to 11 U.S.C. § 1101 et seq. On 8 January 1997, appellee Anemone, Inc. (“Anemone”) filed a motion for “Abstention, Remand, Relief from the Automatic Stay and for Other Relief’ (the “Anemone Motion to Dismiss”).
