Tom, J.

The Court of Appeals, in its remittitur of this case (People v Williams, 27 NY3d 212 [2016], revg 123 AD3d 240 [1st Dept 2014]), asks this Court to decide whether defendant’s unpre-served challenge to the validity of his plea should be reviewed as a matter of discretion in the interest of justice (id. at 224).
