This bill, filed by the secretary of banking of the Commonwealth of Pennsylvania, as receiver of the assets of the insolvent Carnegie Trust Company, against the collector of delinquent taxes of Allegheny County, asks that defendant be ordered to turn over to plaintiff bonds of the Carnegie Coal Company, having a par value of $560,000, assigned to defendant as collateral to secure funds collected and deposited by him with the trust company from time to time in his official capacity. The court below dismissed the bill and plaintiff appealed.
