This proceeding is before the Court on the debtor-plaintiffs’ motion for summary judgment. The debtors appear by counsel Frederick W. Schwinn. Defendant Advanta Mortgage Corporation, USA, servicing agent for Bankers Trust Company of California (collectively “Advanta”), appears by counsel Michael D. Doering.
