McCUSKEY, District Judge. Before the court is the defendants’ unopposed 1 summary judgment motion, d/e 32.

Standard

A party moving for summary judgment must show, from the “pleadings, depositions, answers to interrogatories, and admissions on file, together with the affidavits, if any, ...” that there is no genuine issue of material fact and that the “moving party is entitled to judgment as a matter of law.” Outlaw v.
