CHESNUT, District Judge.
This suit against the Government to recover damages for personal injuries is based on the Federal Tort Claims Act, 28 U.S.C.A., particularly sections 1346, 2671, 2674. The plaintiff, Harry Paly, was seriously injured on a Maryland highway in a collision between his Studebaker passenger automobile and a Dodge passenger automobile driven by David Stefan. The latter was an enlisted member of the^ United States Naval Forces stationed at the Patuxent River Base in Maryland, and had been ordered to act as a military escort for the body of another enlisted man who had…
