HAMLIN, District Judge.
This is an action brought under the “Federal Tort Claims Act”, 28 U.S.C.A. §§ 1346, 2671 et seq., for damages sustained by the plaintiff in a collision with an automobile being driven by an employee of the United States of America. It is undisputed that the accident occurred on the evening of September 2, 1953 on the Eastshore Highway north of Oakland and on the highway between Oakland and Sacramento.
