Westinghouse Electric Corporation (Employer) petitions for review of an order of the Workers’ Compensation Appeal Board which affirmed the Workers’ Compensation Judge’s (WCJ) decision granting a penalty petition filed by Mary Ann Weaver (Claimant).
In a decision circulated on June 28,1996, a WCJ found that Claimant sustained a work-related injury on October 22, 1993 in the nature of a herniated disc in her cervical spine at C6-7 on the right and an aggravation of a preexisting nerve root compression due to an ostephyte in her cervical spine at C5-6.
