1Opinion of the CourtEggleston, J.

On January 5, 1937, John Galleher wrote Edith H. Nesbit requesting payment of a bill of $1,000 for legal services which he had performed for her during the year 1933. It is *146agreed that the amount charged was fair and reasonable and was due and payable on January 24,1934.

At the date of this letter Galleher was indebted to Edith H. Nesbit in the sum of $500, evidenced by a note payable to her order and due on March 31, 1937. This note she had endorsed and placed at a local bank for collection.

In response to Galleher’s letter Edith H. Nesbit wrote him, under date of January 12,1937, as follows:…
