LAY, Chief Judge.

The principal question in this case, and one that federal courts constantly confront, involves the liability of a police officer under section 1983 of the Civil Rights Act for making an invalid arrest. Twenty-seven years ago, Justice Frankfurter predicted that the federal courts would become a haven for litigation of state false arrest and false imprisonment claims. Monroe v.
