delivering the opinion of the court:

This cause comes on for decision following re-argument. The opinion up for reconsideration is reported supra, p. 82, 90 A.2d 660. Reference to supra, p. 177, 91 A.2d 57, 60, will disclose that defendant was granted this re-argument for the limited purpose of showing, if it could, that the conclusions heretofore announced by the court were in contravention of the terms of Para. 2046, Revised Code of Delaware 1935.
