I. The Facts

The Board of Commissioners of Stark County, Ohio (“the Board” or “the plaintiff’) contracted with the defendants, Cape Stone Works, Inc., and Stephen Lonsdale (collectively, “Cape Stone” or “the defendants”) to supply specifically cut stones to rebuild the clock tower of the Stark County courthouse in North Canton, Ohio.
