The nncontradicted facts in this case are: Appellee and plaintiff below, Mattie L. Stacy (nee McKinney), *185was on August 28, 1915, just past eighteen years of age and living with her mother and sisters at Dayton, Ohio, to which place she and her mother had moved from Estill county, Kentucky, some years before, shortly after the death of her father.
