This was an action to recover sums of money alleged to be due the plaintiff for wheat delivered to defendants in the years 1927 and 1928.

*597Plaintiff was a farmer in Clark county. Defendants operated a public elevator and were engaged in buying and selling grain in Minneola. In the summer of 1927 plaintiff made arrangements with defendants to deliver his wheat crop at their elevator.
