The action is to recover the amount due on three bonds issued by the municipal authorities of the town of Fayetteville in payment for stock subscribed in the Western railroad company, and to compel their payment by the levy of the necessary tax. Demand was made upon the treasurer of the town just previous to the institution of the suit. The defences set up are :

1. That no sufficient demand was made before the action.

2. That the omission to-present the bonds within two years after their maturity to the chief officer of the town, as required by the act of March 22nd, 1875, ch. 243, is a bar to…
