MEMORANDUM OPINION

Before the Court is Larry Shaffer’s Petition to Vacate Order Approving Compromise Settlement and Setting Claim of CNB for Hearing [the Petition] and the answer filed by BancorpSouth Bank, successor to City National Bank of Ft. Smith [collectively CNB]. The Court conducted a hearing on October 19, 2007, and January 16 and 17, 2008, and took the matter under advisement.
