This appeal primarily concerns the issue of whether a defendant’s motion for a new trial based on alleged prosecutorial misconduct may succeed if the circumstances supporting the claim of misconduct were known to the defendant at trial. The issue arises on an appeal by Leona M. Helmsley from the April 7, 1992, order of the District Court for the Southern District of New York (Thomas P.
