This is an appeal on questions of law from the order of the Common Pleas Court, overruling appellant’s motion to vacate a judgment entered in a tax foreclosure action.

On October 19, 1950, a petition was filed by the county treasurer to foreclose a tax lien against a parcel of real estate located in the city of Dayton, Ohio. Numerous parties were named as defendants, including the Gem City Building & Loan Association, hereinafter referred to as the association.
