On the trial of this action in trespass by a judge of the municipal court without a jury, findings were entered in favor of the plaintiffs: That of the minor plaintiff, (an eight year old child), for her personal injuries; and that of her father, the adult plaintiff, for the property damage to his automobile. Both were the result of a collision with defendant’s automobile.

Defendant moved the court (1) to grant a new trial, and (2) to enter judgment non obstante veredicto. The court refused a new trial, but entered judgments non obstante veredicto in favor of the defendant…
