GOFF, Circuit Judge.
This action was instituted by Margaret E. Conoley against the Mutual Life Insurance Company of Mew York to recover the sum of $5,000 on an insurance policy issued by said company on the life of Simeon Conoley, payable to the plaintiff. The case was tried to a jury, and, on the verdict rendered, the court, on the 9th day of January, 1894, entered judgment in favor of the plaintiff for $5,383.33, with interest and costs.
