Willis delivered the opinion of the court.

On the 29th day of May, 1908, The Chicago and Southern Traction Company owned and operated an electric railway through the village of Crete, in Will county, and at the intersection of Exchange and Vincennes streets in that village maintained a small frame depot at which its cars stopped for the loading and unloading of passengers. At that point there is a jog in Vincennes street which runs north and south, and the railroad tracks and depot are not in the street but on private ground, the track being along the west side of the…
