MEMORANDUM OPINION AND ORDER
KANE, Senior District Judge.
This is an appeal under 42 U.S.C. § 405(g) of a final decision of the Secretary of the Department of Health and Human Services (Secretary) denying Jose Gomez’s request for Supplemental Security Income (SSI). There are two issues in this appeal: (1) whether the Appeals Council erred in denying further review by failing to consider the transcript of Mr. Gomez’s hearing before the administrative law judge (ALJ), and (2) whether the Secretary’s decision that Gomez does not qualify for SSI benefits is supported by substantial evidence.
