Michael Clinton, an employee of the Yakima Magazine Center (Center), and R. N. Regan, the *49president of J-R Distributors, Inc., which owns the Center, were convicted by a jury of two counts of selling obscene materials. They appealed these convictions to the Court of Appeals, Division Three. Pursuant to RCW 2.06.030(d) and RAP 4.2, the Court of Appeals certified the case to us. We now vacate those convictions.
