The state charged the defendant, William Outlaw, Jr., with the crime of murder in the first degree in violation of General Statutes § 53a-54a (a),1 assault in the first degree in violation of General Statutes §§ 53a-59 (a) (1) and 53a-8,2 and attempted murder in violation of General Statutes §§ 53a-54a (a) and 53a-49 (a).3 A jury found the defendant guilty as *494charged. Thereafter, the trial court acquitted the defendant of assault in the first degree, but convicted him of murder and attempted murder.
