On January 25, 2012, the Plaintiff Christopher Barella (the “Plaintiff’) commenced this action pursuant to Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq., 42 U.S.C. § 1981, 42 U.S.C. § 1983, and the New York State *150Human Rights Law, Executive Law § 290, et seq. (“NYSHR”).
