BEAUCHAMP, Judge.

Appellant was charged with assault to murder Clyde Deramus and upon conviction was given four years in the penitentiary.

*83The principal actor in this drama, besides appellant and the injured party, is a woman named Jessie Linville, who was formerly married to the appellant.
