Procedural History

Plaintiff-employee James Hutchens (“Employee”) contends he sustained an injury by accident on 12 December 2006 while working as a delivery driver for Defendant-employer Alex Lee (“Employer”). Employer denied that Employee’s injury was compensable, and in July 2007, Employee requested that his claim be assigned for hearing. On 15 May 2009, a deputy commissioner issued an opinion and award denying Employee’s claim.
