SPAIN, Justice.

Appellant, age forty-four and disabled, appeals as a matter of right his conviction of murder and first-degree manslaughter, for which he received a concurrent sentence of imprisonment of twenty and fifteen years, respectively.

Tolman Henson, Jr., had spent the afternoon of June 10, 1989, with his family and friends drinking whiskey and beer, while target practicing in the front yard of his residence, which was located near the city of Manchester in Clay County, Kentucky.
