On October 3, 1967, Morris Pierce, a resident of New Jersey and a painter by trade, was engaged in work upon the Grace Evangelical Lutheran Church in Reading, Pennsylvania when a rope supporting him broke, causing him to fall and to sustain injuries which are alleged to have caused his death. This case originated in a suit brought by Pierce’s wife on behalf of herself and her three minor children and also by the Administrator of Pierce’s estate.
