Before the Court are Plaintiff Positive Software Solutions, Inc.’s (“Positive Soft ware”) motion for preliminary injunction and impoundment under the Copyright Act and Defendants’ motions to compel arbitration. Defendant New Century Mortgage Corporation (“New Century”) has recently advised the Court of certain conduct from which it is willing to abstain in the future (although it did not agree to entry of an injunction); the Court grants Positive Software injunctive relief to that extent.
