The plaintiffs brought suit in the circuit court of Shelby County against the defendant to recover $10,000.00 as commissions earned as sole agents of the defendant- for the sale of property belonging to the defendant, and in the alternative for the recovery of damages, upon a quantum meruit basis, for breach of contract in withdrawing the listed property from the market, the gravamen of the charge being that the defendant’s act in so withdrawing the property was an act of bad faith and at a time when plaintiffs had produced a purchaser who was ready, willing and able to buy on terms…
