The City of Denver filed its complaint in forcible detainer under the statute, against the Petry partnership and others, alleging ownership of certain described property located in the area of its proposed Valley Highway now in course of construction. It also alleged that the Colorado and Southern Railway Company, from which it had acquired title, had previously executed a lease to The Summit Grain Company, and that defendant Petry partnership was in possession by virtue of being an assignee of the grain company.
