The plaintiff was denied appointment to the position of correction officer in Nassau County due to a color vision deficiency, and he commenced this action pursuant to the Human Rights Law (see, Executive Law §§ 296, 297 [9]), inter alia, to direct the defendant Nassau County Civil Service Commission to appoint him to that position.
