*839Proceeding pursuant to CPLR article 78 to review a determination of the respondent New York State Department of Motor Vehicles Appeals Board dated September 29, 2009, which affirmed a decision of an Administrative Law Judge dated January 9, 2009, following a hearing, to revoke the petitioner’s driver’s license pursuant to Vehicle and Traffic Law § 1194 for refusal to submit to a chemical blood-alcohol test.

Adjudged that the determination is confirmed, the petition is denied, and the proceeding is dismissed on the merits, with costs.
