*593In an action for a judgment declaring that certain positions created by the defendant Westchester County are in violation of the Civil Service Law and General Municipal Law, the plaintiff appeals from so much of an order of the Supreme Court, Westchester County (Jamieson, J.), entered February 23, 2005, as granted the defendants’ motion, in effect, to dismiss the complaint.

Ordered that the order is affirmed insofar as appealed from, with costs.
