OPINION

TOM G. DAVIS, Judge.

Appeal is taken from a conviction for driving while intoxicated. After the jury found appellant guilty, the court assessed punishment at 10 days and a $500.00 fine. The court ordered that the period of con finement and $200.00 of the fine be probated.

Sergeant Joe Peters, of the Texas Department of Public Safety (DPS), testified that on May 22,1976, he observed appellant driving an automobile on Highway 71 near Austin.
