Foley v. O'Flynn
Massachusetts Supreme Judicial Court
1Opinion of the CourtLummus, J.
The defendant, an experienced stable keeper, let to Mary Foley and Pauline Nardi a pair of horses and a wagon under the charge of a servant, seventy years old and experienced with horses. The defendant knew that the wagon was to be decorated with paper bunting and was to be used to carry a party of cheering schoolgirls during the afternoon of the class games, in accordance with an annual custom for many years. On the road the horses became restive. One of them kicked the footboard on which rested the feet of the two girls named, who were sitting with the driver, and they were hurt.
