As grounds for a writ of. prohibition, it is set up in the present motion to the effect that after, adverse termination and a binding and final judgment on appeal in the case in the district court of Dallas county of Galbreath et al. v. Farrell (Tex. Civ. App.) 249 S.W. 277, and in the case in the district court of Collin County of Galbreath et al. v. Farrel (Tex. Civ. App.) 275 S. W. 238, the same parties have again filed suit in the district court of Dallas county, seeking in the proceeding to retry or relitigate the same matters as presented in the cases mentioned.
