This suit is on the common counts, and a special count which alleges “that on or about the 19th day of August, 1912, the plaintiff contracted with the defendant to perform all the work in excavating, at the Baltimore Fidelity Warehouse, corner of Iiillen and High streets, in the City of Baltimore, according to drawings and specifications prepared by Emory & Hussear, Architects, including all trenches and footing foundations, at and for the price for excavating and hauling of $1.35 per yard.
