I. Procedural Background
Pending before the Court is a Motion for Summary Judgment filed by Eurobank (docket # 161) and an Opposition to the Motion for Summary Judgment and a Cross-Motion for Partial Summary Judgment filed by Redondo Construction Corporation (“debtor”)(docket # 169).
