ORDER

BRITT, District Judge.

Plaintiff instituted this civil action seeking relief from alleged trademark infringement and unfair competition. See 15 U.S.C. § 1114 (1976). Defendant filed motions to dismiss for lack of personal jurisdiction, Fed.R.Civ.P. 12(b)(2), improper venue, Fed.R.Civ.P. 12(b)(3), and insufficient service of process, Fed.R.Civ.P. 4. Pursuant to order of referral, Magistrate Logan D. Howell filed his memorandum and recommendation in which he recommended that the motion to dismiss regarding in personam jurisdiction be allowed. 1
