Defendant has moved for dismissal, asserting lack of jurisdiction in this court.

Plaintiff’s amended complaint alleges jurisdiction under the Federal Tort Claims Act, 28 U.S.C.A. §§ 1346, 2671-2680. The claim asserted arises out of medical treatment received by the plaintiff at the Veterans’ Administration hospital at Minneapolis and may be briefly summarized as follows: Plaintiff, at some time past, while serving in the armed forces suffered an injury to his left leg and hip.
