Currently pending before the Court are Plaintiff Rainbow USA, Inc.’s Motion for Summary Judgment (Rec. Doc. 127) and Defendant Nutmeg Insurance Company’s Motion for Summary Judgment (Rec. Doc. 129). The primary issue before the Court for resolution in these motions is how the “ultimate net loss” provision in Plaintiffs insurance policy is to be applied. These motions came on for oral argument on February 24, 2010. At that hearing, the Court ruled that the provision is ambiguous. The Court also indicated that it would defer ruling on the motions…
