MEMORANDUM AND ORDER
VAN BEBBER, Chief Judge.
Plaintiff brings this action against the United States 1 under the Federal Tort Claims Act (“FTCA”), 28 U.S.C. § 1346(b) and § 2671 et seq. Before the court are the following:(1) Defendant United States’ motion (Doc. 223) to dismiss pursuant to Fed. R.Civ.P. 12(b)(1), or, in the alternative, for summary judgment pursuant to Fed.R.Civ.P. 12(b)(6);(2) Plaintiffs motion (Doc. 227) for partial summary judgment pursuant to Fed. R.Civ.P. 56(a); and(3) Defendant United States’ Motion (Doc. 174) to designate Kansas City, Kansas as place of trial.
