MEMORANDUM OPINION

ROSEMARY M. COLLYER, District Judge.

On June 5, 2008, the Court granted the United States’s Renewed Motion to Dismiss and the United States was dismissed from this case. See Dkt. ## 85 & 86. The Court determined that it lacked subject matter jurisdiction under the discretionary function and independent contractor exceptions to the general waiver of sovereign immunity contained in the Federal Tort Claims Act (“FTCA”), 28 U.S.C. § 2671, et seq.
