*1279Appeal from an order of the Supreme Court, Erie County (Donna M. Siwek, J.), entered August 13, 2004. The order granted the motion of defendant Colline Khoukaz for summary judgment and dismissed the amended complaint against her.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs, the motion is denied and the amended complaint against defendant Colline Khoukaz is reinstated.
