These cases are before the Court on the request of Texaco, Inc., Mobil Oil Cor poration, Exxon Corporation, Clark Oil and Refining Company, Crown Central Petroleum Corporation, and the Independent Refiners Association of America (plaintiffs herein) for a permanent injunction staying the effectiveness of the Interim Decision and Order issued by the Department of Energy (DOE) on July 20, 1978, and the Federal Energy Regulatory Commission’s motion to dismiss or, in the alternative, for summary judgment.
