—Proceeding pursuant to CPLR article 78 to review a determination of the respondent Robert D. Thoubboron, as Sheriff of Putnam County, dated October 30, 1998, which adopted the findings and recommendation of a Hearing Officer dated October 29, 1998, made after a hearing, finding the petitioner guilty of *382misconduct, and terminated her employment as an office assistant with the Putnam County Sheriffs Department.

Adjudged that the determination is confirmed and the proceeding is dismissed on the merits, with costs.
