Plaintiff has sued for a divorce. Her complaint .alleges in substance that she and the defendant were married in the State of Massachusetts on September 29, 1923; that a child was born of this marriage on December 15, 1924; that the marriage has'never been dissolved, and that on July 29,1942, the defendant married the corespondent and has since lived with her in this State in open adultery.

Defendant admits that he and the plaintiff entered into a marital ceremony in Massachusetts on September 29, 1923, but alleges as a defense that this marriage was null and void. The basis for his allegation…
