PROCTOR, Circuit Judge.
This appeal concerns the validity of a ceremonial marriage at Baltimore, Maryland, between the parties, and the legitimacy of a child born to appellant.
■ The controversy grows out of the following facts. Merton A. Oliver, appellee, was the husband of Frances Mae Oliver. She sued for absolute divorce in the District Court upon the ground of desertion. The divorce was granted April 17, 1946. The decree, drawn agreeably to § 421 of Title 16, D.C.Code (1940), 1 2 provided that the divorce was not to become “absolute and take effect” until six months after date of the…
